A fair and equitable divorce settlement is the best result for all parties, including the children.

And while most couples would prefer to achieve this result without the expense or added stressor of litigation, sometimes it is a necessary step toward that goal.

There are few reasons litigation might be the right choice for your situation:

One or both spouses have significant financial assets

Particularly in a high-net-worth divorce, obtaining a complete understanding of the couple’s financial situation is critical. Financial discovery is important so that your attorney can thoroughly understand the assets (including marital and separate property assets), liabilities and significant executive compensation packages that may be overlooked in mediation.

During litigation your attorney can review discovery, take depositions under oath and issue subpoenas to third parties including credit card companies, mortgage lenders, employment and investment advisors, among many others, to get a full and unbiased financial accounting upon which to build a case for financial support and division of assets.

There is a fundamental disagreement on custody

Couples who cannot agree on how to address parenting the children often end up in litigation. These cases are particularly complex and emotional and require the nuance of a knowledgeable and empathetic attorney who can take the parent and child’s best interests into consideration.

Mental health disorders or domestic violence

When one or both spouses suffer from a mental health disorder, or there has been emotional or physical abuse, it is more difficult to come to an agreement on anything without an unbiased third party involved.

Often a declaration from the Court with the weight of the law behind it is the only way to achieve a fair result and adherence to the settlement.

One or both spouses simply cannot agree on a settlement

Even if you do not consider yourselves to be a high-conflict couple, when you cannot agree to a settlement on your own or working with your lawyers, you likely will need to litigate.
